Can You 'Get Busy' In A Public Restroom In Missouri?

In "The Humpty Dance" by Digital Underground, Shock G playing the character of Humpty Hump raps:

"I'm a freak, I like the girls with the boom
I once got busy in a Burger King Bathroom."

So would Shock G have broken the law if he engaged in that behavior here in Sedalia or Missouri?

The answer is yes. So how did I wind up going down this rabbit hole? I was actually poking through the Sedalia Municipal Code looking for something else when I stumbled upon Sec. 36-184 of the code dealing with Conduct in public bathrooms.

It's not a law every municipality has on the books. I checked the Warrensburg and Columbia municipal codes and didn't see anything dealing with conduct in public bathrooms. Although there might be an answer to why many municipalities don't specifically address the issue.

According to the Sedalia Municipal Code, a public bathroom defined by the code is any public bathroom in a City of Sedalia park. When it comes to bathrooms in Sedalia parks, don't think about giving or receiving fellatio, cunnilingus, or just engaging in good old-fashioned intercourse.

Additionally, don't even think of touching, petting, groping, or anything like that, not even through the other person's clothes. You can't even kiss, hug, or have more than one person in a stall in a public restroom. Or engage in any of these behaviors within 250 feet of a public restroom.

When it comes to the Sedalia code, it's specifically addressing bathrooms in the City's parks. When it comes to sex in a bathroom in a restaurant, a business, or some other place where other people might be, that's covered by Missouri's sexual misconduct laws.

In Missouri, if you show your private parts in circumstances that will likely "cause affront and alarm" you have committed first-degree sexual misconduct. Additionally, if you have sexual contact in front of another person or persons knowing it will alarm them, or if you have sex in a public place in front of another you've committed first-degree sexual misconduct.

Find law says, assuming someone hasn't been convicted of this before, he or she will be charged with a Class B Misdemeanor subject to six months in jail and a $500 dollar fine.

So no, you can't get busy in a Burger King bathroom. Or any other bathroom that the public has access to in Sedalia or Missouri without at least risking arrest.
